What to expect
Most family law cases begin with a petition filed in district court, followed by a response from the other party, an exchange of financial information, and in many cases mediation. Many cases settle by agreement without a trial. When they don't, I prepare every case as if it will be heard by a judge, so you are ready either way. When children are involved, Montana courts decide parenting issues based on the best interests of the child, and I help you show the court what that looks like in your family.
Full service or limited scope
Not every case needs an attorney from start to finish. I offer full representation, and I also offer limited scope representation, where I handle specific parts of your case, such as drafting documents or preparing you for a hearing, while you handle the rest. We'll talk about which approach fits your needs and budget.
Common questions
Do I have to go to court? Not always. Many divorces and parenting cases are resolved by agreement, and the court approves the final documents. Some cases require at least one hearing.
My ex and I already agree. Do I still need a lawyer? An agreement that seems simple can leave out important details about retirement accounts, debts, or holiday schedules. A review now can prevent a motion to modify later.
Can a parenting plan be changed? Yes, if circumstances have changed and the change serves the child's best interests. Some changes also have timing requirements.
